Synlab Ghana in court over wrongful abrogation of appointment

A chartered and cer­tified public accountant, Mark Antwi-Bosiako has sued Synlab Ghana Ltd at the High Court in Accra, for unlawfully terminating his appointment.

He is asking the court for a declaration that the termination of his appointment by Synlab Ghana Ltd, was unlawful.

The plaintiff is again urging the court to order Synlab Ghana Ltd, the defendant, to pay appropriate compensationto him, commencing from the date of purported termi­nation to the date of final judg­ment, damages and costs including litigation.

Mr Antwi-Bosiako is repre­sented by Abigail Ofori Appiah of Aboagyewaa Chambers.

The plaintiff stated that he is a qualified Chattered and a Certified Public Accountant with about 28 years working experience, having worked with KPMG and Edward Jones Investments, both in the United States of America (USA).

He said that the defendant is a member company of Synlab Group International, a Global Medical Diagnostic Company with presence in four continents and 42 countries including Ghana.

It is Mr Antwi-Bosiako’s case thatuntil December 2022, he was the Chief Finance Officer (CFO) of the defendant company, Synlab Ghana Ltd.

He said that by a letter dated January 31, 2018, he was appoint­ed by the Director of Finance of Medlab Ghana Ltd in 2018.

Mr Antwi-Bosiako said that pri­or to his appointment as the Direc­tor of Finance Synlab Group Inter­national held 75 per cent shares in Medlab Ghana Ltd, and therefore had the powers of appointments and termination of appointmentsin Medlab Ghana Ltd.

The plaintiff said that subse­quent to his appointment, Medlab Ghana Ltd was fully acquired by Synlab Group International in 2020 when they bought the remaining 25 per cent and thereafter Medlab Ghana Ltd became Synlab Ghana Ltd.

He said that he continued to play his role as the Director of Finance with Synlab Ghana Ltd, but his position was renamed Chief Finance Officer, in line with the policy of Synlab Group Interna­tional.

Mr Antwi-Bosiako stated that he took on an additional responsi­bility as the Regional Compliance Officer for Synlab International at the behest of the Group Company.

The plaintiff holds that he also acted as the Managing Director of Synlab Ghana Ltd for a short pe­riod when the appointment of the then Managing Director was termi­nated by Synlab Group Internation­al and he played all these roles to the best of his ability, protecting the Defendant’s interest at all times.Mr Antwi-Bosiako indicated that to his utmost surprise and dismay, he was served with a letter dated January 6, 2023 from the management of the defendant, unilaterally terminating his appointment with the defendant without prior notice.

The plaintiff said that the defendant paid to him what was termed “severance package,” which included a three months’ salary in lieu of notice.
