Court affirms Nii Amanor Dodoo as legitimate receiver for Unibank

The Court of Appeal has confirmed that the appointment of Nii Amanor Dodoo by the Bank of Ghana (BoG) as the receiver of the defunct UniBank was legitimate.

The ruling delivered on December 1, 2022 overturned the High Court decision that it was wrong for Mr Amanor to have accepted the BoG’s appointment, the Bank of Ghana said in a statement copied to the Ghanaian Times in Accra on Friday.

The High Court had granted an application by Dr Kwabena Duffour, and the other defendants asking the court to struck out a case against them by the receiver in a civil suit that sought to recover over GH¢ 5.7 billion from Dr Duffour and the other defendants.

They argued that NiiAmanorDodoo should not have accepted the BoG appointment as receiver of UniBank, as two years had not passed since he worked on the team of the official administrator of UniBank.

The High Court granted their request but Mr Amanor Dodoo appealed against the decision at the Court of Appeal on June 28, 2021.

In a unanimous decision read by Justice Richard A. Frimpong, the Court held that the High Court erred in its interpretation of the relevant provisions of Act 930, and that NiiAmanorDodoo was properly appointed as receiver.

The court also referred to and endorsed its earlier decision a related case, affirming that Mr AmanorDodoo was validly appointed.

The decision by the court paved the way for Mr Dodoo to continue with his work as receiver tasked with recovering the monies he claimed were taken out of UniBank by Dr Duffour and the other defendants.
