Tussle over Ga Mantse palace: Nii Tackie Adama Latse II files case against Nii Dodoo Nsaki

Nii Tackie Adama Latse II has filed an application for an order of Mandamus at the Human Rights Division of the Accra High Court, to compel Nii Dodoo Nsaki II to vacate his position as the acting president of the Ga Traditional Council.

This is to enable him (Nii Adama Latse II) to assume his rightful position as the substantive paramount chief of the Ga Traditional Area, and automatic president of the Ga Traditional Council. This is in accordance with Section 13 of the Chieftaincy Act, 2008 (Act 759).

According to the writ filed by Akwetey and Associates, the plaintiff stated or averred that it was Nii Nsaki II (defendant), who signed the requisite Chieftaincy Declaration (CD) forms when he, Nii Tackie Adama Latse, was installed Ga Mantse on June 11, 2011, by the Royal Stool Dzase, and transmitted same to the Greater Accra Regional House of Chiefs for onward registration by the National House of Chiefs, Kumasi, the Ashanti Regional capital.

It indicated: “The National House of Chiefs duly effected my registration as the Ga Manste and Paramount Chief of the Ga traditional area on April 24, 2015.”

The writ indicated that “after my registration, my Dzasetse invited the respondent herein by a letter, dated February 13, 2017, to induct me into the Ga Traditional Council, to enable me assume office as the president of the council.

“The respondent, Nii Nsaki II, responded by promising that he would carry out the induction after the ban of drumming and noise-making is lifted, but instead of carrying out his promise to induct me into office and vacate the office as acting president of the Ga Traditional Council, he failed to honour his promise,” the plaintiff said.

Nii Adama Latse II has, therefore, accused the respondent of “deliberately instigating opponents of my selection and installation as Ga Mantse, to initiate one legal suit after the other from the Greater Accra Regional House of Chiefs through four  high courts all the way to the Supreme Court, to perpetuate himself in office as acting president of the Ga Traditional Council, and to frustrate me from assuming my statutory position as president of the Traditional Council in accordance with the Chieftaincy Act”.

The plaintiff stated that the Supreme Court  by an unanimous ruling delivered on February 6, 2019, indicated that “all the suits filed by the proxies of the respondent in the various high courts as well as reactions from my lawyer in respect of those high court cases were struck out as cases relating to causes or matters affecting chieftaincy”.

Nii Adama Latse II said in the writ that Nii Dodoo Nsakai II per a letter dated November 9, 2018, requested him (plaintiff) to provide the customary items and money for his induction into the Ga Traditional Council.

These  included, GH¢10,000.00,one bull, one white sheep, one carton of schnapps, four cartons of beer and four crates of soft drinks, which were duly provided and the respondent acknowledged receipt of same through a letter he wrote.
