Jury to hear KKD’s rape case

KKDACE broadcaster, Kwasi Kyei Darkwa, affectionately called KKD, who is alleged to have raped 19-year-old Ewuraffe Orleans Thompson would on Wednesday, April 22, appear before a jury at an Accra Fast Track Court for trial.

Assistant State Attorney, Malik Woanya, told the court yesterday that since the case was a trial of indictment, a jury could hear it and therefore requested for a date for the hearing to commence, with the composition of the jury.

The request was met with harsh response from the defence counsel, Anthony Forson Jnr., who said the prosecution had not treated them fairly.

After being calmed down by the trial judge, he said as practised at the bar, it was just prudent for state prosecution to inform them earlier that the case would not commence yesterday, adding that the State had enough time to begin every necessary process, after his client was committed for trial last month.

Justice Bright Mensah, the Presiding Judge, consequently adjourned the case to April 22, on the request of the state prosecution.

Both MalikWoanya and Anthony Forson Jnr, agreed to the date.

The jury would be made up of ordinary individuals who are neither judges nor lawyers and would determine the outcome of the case after hearing evidence from both parties.

After the composition of the jury, both parties would have the right to an objection, should any of them have any concerns about an inclusion of a member.

Prior to yesterday’s sitting, the Kaneshie District Magistrate Court, presided over by Mrs Adwoa Akyamaa Ofosu, had committed KKD to the charge of rape on February 18, and urged the prosecution to proceed to the High Court for trial.

The state prosecutor, Malik Woanya, told the court that on December 27, 2014 the victim, Ewuraffe Orleans Thompson, accompanied her cousin, Abena, to a fashion show dubbed “Rap the runway fashion show” at the African Regent Hotel.

There, they met KKD, who made some remarks about the victim and they became friends. They then walked to the hotel lobby where KKD introduced her to Kofi Okyere Darko (KOD) and Benny Blanco and told them she was his new friend.

The prosecutor added that after the pleasantries, KKD told victim and her cousin that he would make them the faces of the Ghana Tourism Campaign after which a publicist, Ameyaw Debrah, and KOD took photographs of them.

They later took a lift to the suite, together with victim’s cousin and KOD.

In the living room, Ewuraffe and her cousin were offered drinks, which they refused.

KKD, the prosecutor said went into the washroom, came out, and invited victim in to help him with his make-up.

She said when the victim entered, KKD started making sexual advances at her, which she resisted, but he perservered and locked the washroom.

The prosecution said KKD removed his pants, but victim told him she was a virgin; but he overpowered and forcibly had sex with her.

A complaint was made at the Airport Police Station and a police form was issued to her to seek medical care and KKD was arrested.

The state prosecution said, victim went to the Police Hospital where an examination was conducted on her.

According to the medical report as presented by the prosecution, victim was before then not sexually active and that there were abrasions on her labia majora and minora and her hymen was torn, adding that there was presence of spermatozoa in her.

She said upon that, the accused was arrested and subsequently arraigned before court, adding that the accused denied the charge of rape.

KKD is currently on bail.
