The JHS pupil’s aunt, the complainant, was also not present.
The two, were absent from the Ho Circuit Court last Friday, when Oyih, made his second appearance before it.
There was also no member of the victim’s family in the court, unlike at the first hearing on March 30.
No reason was given by the prosecution for the absence of the victim and the complainant.
The court, presided over by Mr. Emmanuel Ayesu Essampong, however, denied Oyih bail again and remanded him in prison custody until April 17.
The court has been told that some time last year the accused, 51, resident of Ho, met the girl in town and proposed love to her.
Assistant Superintendent, I. A. A. Ahor, in-charge of DOVVSU, Volta Region, who presented the facts, said that since then, Oyih had been inviting the girl to his house, “for sex, after which he gave her money”.
The victim gave evidence at an earlier sitting.
Mr. Oyih has pleaded not guilty to defilement.
When the case was called soon after 9 a.m., victim and the complainant were not in court.
The accused, on the other hand had turned up, in a blue sports shirt, in the company of family members.
The case was stood down for a while in anticipation of the arrival of victim and the complainant.
When they did not turn up, the court met the accused in camera, before adjourning proceedings.
