Court fines illegal miner GH҃¢12,000

The Bolgatanga Circuit Court on  Tuesday   presided over by Melcolm Bedzrah   has sentenced a 33-year-old farmer,  Yaba Adireba, to pay a minimum 1,000 penalty unit which is equivalent to GH҃¢12,000 for mining  without authority contrary to section 99 of the Mineral Act 206 Act 703 .

Adireba will go to prison for one year with hard labour, if he fails to honour the payment.

The accused person pleaded not guilty with explanation but his plea was not taken by the court.

Meanwhile his accomplish  Issah Hamzah, 20 , unemployed, who is the second accused in the case,  is on the run.

The court which had issued another bench warrant for the police to produce the second accused person in court on the February 10, 2018, for trial, otherwise the surety should be made to appear before the court on the said date.

Presenting the facts of the case, the prosecutor, Inspector K.O. Boateng told the court that upon a tip-off, the accused persons were arrested at Naaga, a suburb of the Navrongo municipality in October 27, 2017, and when questioned about their mining licenses, they failed to produce them hence their arrest and arraignment before the circuit court.

The two accused persons who were earlier on arrested   by the police and arraigned to appear before the court last month failed to do so, thereby compelling the court to issue the bench warrants for their arrest which led to the first accused appearing in court to be sentenced whilst the second accused did not turn up, making the court to issue a second bench warrant to his arrest.
