Bature Files Notice Of Appearance To Sam Jonah’s Writ

BatureThe Managing Editor of The Al Hajj newspaper, Alhaji Bature Iddrisu, has filed a notice of appearance in a suit brought against him before an Accra Fast Track High Court for an alleged defamatory publication against businessman, Dr. Sam Jonah.

Counsel for Alhaji Bature, Charles Zwennes of Gaizie, Zwennes Hughes & Co law firm, last Thursday entered the appearance following a writ of summons served on his client on February 6.

Alhaji Bature, as required by law, will subsequently file a defence for hearing to commence sometime this month in the suit in which Dr. Jonah is demanding, among other things, GH¢10 million as damages from Alhaji Bature and Hazret Company Limited, publishers of The Al Hajj newspaper.

Dr. Jonah has averred in the summons that he was deliberately discredited in the publication carried out on December 17, 2013 with the headline “Dangerous Rivalry with Ibrahim Mahama: Sam Jonah Targets JM” in The Al Hajj newspaper.

Dr. Jonah is primarily seeking GH¢10 million damages for the alleged libel contained in the story and published on the front page of the December 17, 2013 edition of the paper.

He is also seeking a perpetual injunction to restrain the paper from further publishing similar stories against his personality.

The plaintiff prayed the court to direct the defendants and compel them to “publish a full and unqualified apology to the plaintiff and retraction of the story” and a declaration that the story was “false, malicious and defamatory.”

In his statement of claim, the former AgloGold Ashanti Chief Executive said the defendants deliberately and maliciously published the story to “seriously injure his character, credit, and reputation” and consequently brought and exposed him to “public scandal, odium and contempt”.

He insisted that the publication made him to “suffer serious harm and damage to his character and integrity as a responsible man and caring father by being portrayed to right thinking members of society as a father who allegedly abandoned the responsibility of his son by the said Ibrahim Mahama’s wife.”

According to him the publication also caused serious damage to his impeccable international reputation in global business and leadership by portraying him as someone who meddles in petty politics with the sole objective of destroying businesses of persons he has an alleged non-business rivalry with.
